1. AGREEMENT
By using the HealthExpense.com information, tools, features and web application (together the "Service"), you agree to be bound by this Agreement, whether you are a "Visitor" or a signed up "Member". Your use of HealthExpense.com software is governed by this agreement. HealthExpense.com is located at 440 N. Wolfe Road, Sunnyvale, CA, 94085.
2. YOUR USE OF THE SERVICE
HealthExpense.com information, application, and website are referred to as HealthExpense.com software in this document. Your use of HealthExpense.com website and application is limited by HealthExpense.com agreements with your employer / benefit broker. HealthExpense.com software may be provided as part of your benefits package. Continued use of the software after termination of employment or without the permission of your employer will require your consent to a 'Personal Software Use Agreement'. Subscription fees for personal use will be determined at a later date.
HealthExpense.com hereby grants Employee a non-exclusive, non-transferable, fully paid, non-assignable license (with no right to distribute or sublicense) to use of its software solution. HealthExpense.com will provide access to a web based application based on username and password authentication. Employee agrees that the username and password required for authentication to HealthExpense.com web based application will not be shared or disclosed under any circumstances.
The HealthExpense.com Software is provided "as is".
3. NON MEDICAL ADVICE
HealthExpense.com does not offer medical advice. Any information provided by HealthExpense.com or content accessed through its software is for informational purposes only. It should not be used to make medical decisions. Please consult your doctor, pharmacist, or other qualified medical provider if you have any questions about a medical condition, or before taking any drug, or taking any actions that may affect your health. Call 911 for all medical emergencies.
4. NON FINANCIAL ADVICE
HealthExpense.com is not a financial, tax, insurance, or retirement advisor. Any information provided by HealthExpense.com or content accessed through its software is for informational purposes only. It should not be used to make financial, insurance, or retirement decisions. Please consult your accountant, insurance professional, health insurance company, or human resources department if you have any questions about financial, insurance, or your employer’s health and retirement benefits.
5. YOUR ACCOUNT
You must provide accurate and complete registration information when you register to use HealthExpense.com software. You are responsible for the security of your passwords and for any use of your account. You must immediately notify both your employers and HealthExpense.com of unauthorized use of your account. HealthExpense.com can be contacted at support@HealthExpense.com You must be at least 18 years old to HealthExpense.com software. You may not access HealthExpense.com software or web site other than by the interfaces provided by HealthExpense.com
6. PRIVACY OF YOUR INFORMATION
You control who can access information about yourself and your minor children (under 18) in the HealthExpense.com application. By default, you are the only user who can view and edit and your minor children’s information. If you choose to, you can share your information with your spouse or partner.
You can completely delete your information at any time. Such deletions may take immediate effect in your account. Since deleted data will not be restored, you may want to print information before deleting it. Backup copies of deleted information may persist in accordance with internal backup, retention and archiving policies.
By accessing and using the HealthExpense.com software you chose to offer us your personal information. This information is used to serve your needs. We administer this data in a manner that is consistent with applicable state and federal laws, rules, regulations, or other legal obligations.
HealthExpense.com will not share information in its databases about you with your Employer or any third party that would uniquely identify you or disclose information you provide about yourself.
HealthExpense.com will disclose to the appropriate legal authority your personal health information if required to do so under state or federal laws.
HealthExpense.com may provide information about populations while complying with HIPAA population guidelines and information about more than two persons not related by a family relationship that has been cleansed to remove all identifying information with your employer and third parties.
7. SECURITY AND HIPAA
HealthExpense.com implements administrative, physical, and technical safeguards to protect the confidentiality of information in its databases; and HealthExpense.com maintains reasonable policies to limit access and detect, contain and correct security violations. HealthExpense.com is not a "covered entity" under the Health Insurance Portability and Accountability Act of 1996 as defined by the regulation and is therefore not governed by its ("HIPAA") regulations including but not limited to Title 45, Section 164.504(e) of the code of Federal Regulations ("CFR"). As a result, HIPAA does not apply to the storage of health information by HealthExpense.com and transmission of health information to any third party. HealthExpense.com is not required to comply with HIPAA regulations but maintains HIPAA level confidentiality of you and your dependent children’s (children under age 18) individually identifiable data as noted in the previous section.
8. TERMS
When you provide login information to third party websites which enables HealthExpense.com to access your information including but not limited to your health information and financial information you are authorizing HealthExpense.com to act on your behalf, as your agent, to access health benefit information, health insurance, payroll, and financial records for you and your dependents including but not limited to explanation of benefits statement, payment information, payment records, balances, and financial transactions from your employer, insurance company, financial services provider, bank, credit card company, pharmacy, healthcare providers, and employer payroll processing company.
You may terminate this agreement by both
1. deleting your data in the HealthExpense.com application and software, and
2. By sending an email to support@HealthExpense.com requesting account deletion.
HealthExpense.com will provide notification of your request to delete your information. Once you delete your data, HealthExpense.com will not be able to recover or restore the data.
9. LICENSE
HealthExpense.com own all proprietary rights to the HealthExpense.com software. HealthExpense.com gives you a personal, revocable, non-assignable, and non-exclusive license to its HealthExpense.com application.
10. CHANGES TO THIS AGREEMENT
HealthExpense.com may change this agreement at any time and will post the modified agreement at http://HealthExpense.com/terms. If you do not agree to the modified agreement, you should stop using HealthExpense.com Your continued use of HealthExpense.com software after the date the modified agreement is posted will constitute your acceptance of the modified agreement.
11. EXCLUSION OF WARRANTIES
HealthExpense.com DOES NOT MAKE ANY EXPRESS WARRANTIES, AND DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. HealthExpense.com DOES NOT MAKE ANY WARRANTY THAT THE DATA IN HealthExpense.com IS ACCURATE, OR SATISFIES OR COMPLIES WITH ANY STATE OR FEDERAL GOVERNMENT REGULATIONS.
12. LIMITATION OF LIABILITY
NEITHER YOU NOR HealthExpense.com MAY BE HELD LIABLE UNDER THIS AGREEMENT FOR MORE THAN $1,000 IN DAMAGES, OR PENALITIES FROM EITHER A COURT OR ARBITRATION AWARD
